We work on the basis of the general fee criteria (AHK) and the Lawyers' Tariff Act (RATG). As a rule, we also agree an hourly rate with our clients. In our experience, this fee structure is usually the most transparent procedure, and is also the cheapest option - especially for amounts in dispute that are higher for economic reasons. In individual cases, we are also happy to agree on a flat fee.

The focus here is on the drafting of employment contracts, including those of senior employees, and in employer advice. Conducting labor law proceedings (dismissal challenges, dismissal, etc.) is part of our core business. Together with our long-standing partners, Gaedke & Partner Steuerberatung GmbH, we can also advise at the interface with social security law and international labor law (temporary employment, secondments).
Austrian construction law differs from the relevant German legal situation due to the fact that the Austrian central standard is Ö-Norm B 2110. We represent both contractors and clients in defect proceedings or in connection with claims for additional costs.
Given the European legal requirements of the General Data Protection Regulation, many data protection regulations are comparable to the German legal situation. Nevertheless, there are also specific national requirements and there is now already a rich body of case law from the relevant authorities and courts in Austria (Data Protection Authority, Federal Administrative Court, Administrative Court and Constitutional Court). We advise in connection with complaints procedures before the Data Protection Authority and the courts of public law, as well as in the preparation of relevant data protection contracts (contract processing, contracts concerning joint responsibility). Advice in connection with the negotiation and preparation of software license agreements, which necessarily have to comply with national copyright requirements, is also part of our core business.
We have been advising regional and Austria-wide electricity supply companies (EVUs) for decades in connection with the design of network access contracts, end customer contracts and administrative procedures.
Austrian corporate law necessarily differs (sometimes significantly) from the corporate law framework of other legal systems. We have decades of experience in representing foreign owners of Austrian companies and expertise in the associated complexity of corporate law processes, be it changes to the articles of association or representation in decision-making.
We represent clients in the assertion and defense of competition law claims under the Austrian UWG (Law against Unfair Competition), which is comparable to the German legal situation due to the European law determining the relevant legal provisions of its requirements. Differences arise in particular in the procedural assertion, the scope of prohibitions and the jurisdiction of courts.
We have many years of experience in representing German clients before Austrian courts. The Austrian civil procedural situation is necessarily very different from the German legal situation. On the one hand, this affects the regulation of legal costs, and on the other hand, it also affects the structure of a civil case itself. A particular focus in cases with a foreign connection is necessarily to determine the jurisdiction of the courts in question, which is based on the relevant European regulations, and to explain the (substantive) law to be applied in each case. Ultimately, decisions of Austrian courts must be enforced in Germany or decisions of German courts in Austria, whereby this must be based on the relevant EU legal requirements (in concrete terms, Regulation 1215/2012). We are active in connection with the enforcement of foreign judgments in Austria, and we also advise Austrian clients on enforcing Austrian judgments in other jurisdictions with the help of lawyers in our network.
We represent clients in the preparation of purchase agreements relating to real estate as well as in connection with project development, whereby there is close integration with our construction law expertise.
A key focus of our work is representing companies in connection with the defense of media and personal rights claims. We also conduct proceedings (in particular) against social media platforms.
